The Marsabit Court has fined a driver KSh 300,000 or sentenced him to 12 months in prison after he was found transporting uncustomed 3,600 litres of cooking oil that had been smuggled into the country without paying duty.
Hassan Racho Boru, 33, was found guilty of being in possession of uncustomed goods.The court also convicted the accused on a second count of conveying uncustomed goods, 3,600 litre of cooking oil valued at Ksh 378,000, knowingly to be uncustomed goods which were to be paid a tax of KSh 378,000.
The accused, Boru, was arrested on June 29, 2026, at the KBC police roadblock in Marsabit town while in possession of 180 jerricans containing 3,600 litres of cooking oil that had been imported into the country without having undergone the requisite customs clearance procedures.
The motor vehicle was travelling from Moyale towards Marsabit Town.
Appearing before Marsabit Senior Resident Magistrate Edward Oboge, Boru pleaded guilty to both charges against him.
In delivering the judgment, Magistrate Oboge said the evidence presented in court by the prosecution proved that the suspect was guilty.
The court also ordered that the vehicle used to transport the goods, registration number KDP 587, be forfeited to the state.
The accused has 14 days to appeal.
